Hotel guest trips over improperly placed wheel stop, Crushes shoulder

Ms. Wolfe was a competitive shooter and was further involved in judging for U.S. Olympic shooting tryouts.  On a trip from New York to California, Ms. Wolfe was a judge for an Olympic tryout competition in Southern California.  She was an active NRA member.  One evening, while staying at the Ontario Best Western, she went to an ice machine within the motel complex.  As she was walking back to her room with her ice bucket, she followed the walk way to the parking lot and after stepping off the curb, she immediately tripped over a concrete wheel stop that was placed in the intended pedestrian path.  When she tripped over the wheel stop, she crushed her right shoulder which had to be wired together. 

As a result, she no longer could lift her arm above her head and could not touch her head with her hand.  Plaintiff could no longer compete in rifle and handgun competitions. 

The hotel complex had moved all the wheel stops away from the pathways to avoid a tripping hazard for the patrons, except for the one wheel stop tripped over by Plaintiff.  

Awarded: $730,000.00
