California Highway Patrol received 911 calls reporting a single vehicle rollover on the northbound I-15 south of Bear Valley Road around 12:30 a.m. Javier Leon Chavez, 55, a passenger in the car, had been ejected and pronounced dead on the scene due to trauma to the head and chest. The driver was taken to a local hospital. The cause of the accident is still unknown.
Single car roll over accidents can be tragic and are caused be many different events. These accidents arise from many causes ranging from driver error, intoxicated driving, roadway damage, vehicle defects, tire failures and so many other possibilities. There are many who would assume that if the accident was a single car accident then it must be the driver's fault. This rush to judgment presupposes that everything that could go wrong to cause this accident did not go wrong. This assumption, and the corresponding failure to investigate the alternative causes of the accident, could leave the victim and his family without an otherwise proper recovery.
Another reason for investigating the cause of the accident beyond driver error may help prevent other similar accidents and misery for other potential injury victims. For example, if there is a defective tire which caused the accident, it is important you provide information to the manufacturer so the defect can be corrected and lives saved.
If you are a passenger in a single vehicle accident, speak with an attorney to help you recover proper compensation from the driver's insurance company or from your own uninsured motorist coverage. Don't be ashamed to investigate your rights because the person who caused your injuries was your friend. A good personal injury attorney will work with the insurance company and can do so without seriously affecting your driver.
If you were the driver in a single car accident, but you believed you did not cause your own accident, then consult with a lawyer to see if there was someone or some company that might be responsible for the injuries.
