San Bernardino and Victorville saw two bus accidents in the early days of March 2013. In Victorville, a Victor Valley Unified High School District bus carrying seven disabled students was struck in a traffic collision on March 11, 2013. It was reported that the accident occurred at the intersection of Dos Palmas and Amethyst when a car turned in front of the bus. Fortunately, the injuries were reported as being minor.
A much more serious bus accident occurred in San Bernardino on March 8, 2013, when a Jeep SUV, at a high speed, went through a stop sign hitting a Durham School bus on California Street. The impact was so severe that the SUV hit two other cars. Fortunately, there were no children on the bus at the time of the impact. However, the bus driver and the driver and passenger of the SUV were all injured in the collision.
Bus accidents can result in serious injuries and sometimes death as was seen in the February 3, 2013 Yucaipa tour bus accident resulting in several deaths and many injuries. Do bus passengers have legal rights following a bus accident? They do. However the question is, against whom do they have a claim? Much has to do with the cause of the accident. Sometimes a bus driver can be responsible for the accident. In other situations, the maintenance of the bus may have been the cause of an accident due to the failure of the brakes or engine. Bus companies and their drivers have a higher duty of care to drive, operate or maintain the bus in a proper manner that the general public. This level of care is required whenever a person or company is a “common carrier”, that means one who transports someone or something for money. If, as in these two accidents, the cause of the collision was due to the negligent actions of other drivers, then those drivers alone, or in conjunction with the bus company if it contributed to the accident, can be responsible for the accident and the associated injuries suffered by the passengers on the bus.
