Hesperia Head On Collision Leaves Three Seriously Injured

Posted on Feb 04, 2014
Hesperia, California - As has happened too many times before, there was a head on collision on Saturday morning, February 1, 2014 along Bear Valley Road. In the early morning hours of around 1:45 a.m., two cars collided head on leaving two of three people so seriously injured that they had to be airlifted to a trauma center. A third person was also taken to the hospital following the accident. Fortunately, these accident victims survived and hopefully they will make a speedy recovery from their injuries.
In an accident like this, how do the accident victims prove who caused the accident? This is sometimes more difficult than one may first think. At the time of writing this blog, I am involved in a similar accident to the one mentioned above in Hesperia, California. In this case both drivers have accused the other driver for crossing the center median line thereby causing the accident. Now it is true that both could have been across the center line at the time of the accident, but it is rare to see that situation. So with both drivers accusing the other of being on the wrong side of the center line, an accident re-constructionist may be required to help rebuild the events of the accident and determine the truth of what happened in the accident.
The accident re-constructionist will examine the evidence taken from the scene of the accident, such as skid marks on the road, debris patterns and locations, road configurations, etc. He or she will review the accident investigation report or police report prepared immediately following the accident. He will listen to or read a description of the accident as told from the drivers and/or witnesses of the accident. He will analyze the damage and damage patterns to the vehicles. Cell phone records may be analyzed. Sometimes the expert will even need to perform tests in order to try and replicate the events leading up to the collision.
After all the information has been analyzed, the expert will form an opinion as to what happened, how it happened and who caused the accident. Based in part upon such a report, the truth about the accident starts to be exposed over the cover up by one person or another regarding the cause of the accident. The personal injury attorney will often use the accident re-constructionist to deal with conflicting descriptions of accidents or when there is a conflict with the evidence as to the cause of an accident or the nature and extent of an impact. Often, unless an expert clears up the facts of the accident, the injured victim is unable to recover from the opposing insurance company because of its denial of liability is based upon the erroneous statements of non-liability by its insured.
In any moderate to serious car accident, especially a head on collision, it is important for the injury victim to find a lawyer who can work with him or her, find any necessary experts to prove the case and then pursue a rightful recovery from the insurance company and proper justice for the personal injuries suffered in the accident.
