Case Name Confidential, Semi-Truck v. Pedestrian Accident

Plaintiff was a 56 years old sanitation worker.  His primary responsibility was as a  heavy equipment operator. Immediately prior to the injury, the Plaintiff was standing on the ground directing trucks that were entering the landfill to drop dirt in a designated location.  Plaintiff was standing stationary waiving down the defendant’s truck entering the site and pointing in the direction he wanted the truck to proceed.  The Defendant, with his belly dump truck, entered the area to dump his load.  The Defendant made a left turn as directed by the Plaintiff.  Unfortunately, the Defendant turned too sharply and ended up striking the Plaintiff and running over his left leg.  This truck vs. pedestrian impact caused serious injuries to the Plaintiff

From the accident scene, the Plaintiff was taken by ambulance to a local emergecy room.  Upon his admission, X-rays of his lower left extremity were taken, which revealed a comminuted fracture of the distal tibia and fibula, dislocated pinky toe, and third metatarsal neck fracture.  Additionally, there were fracture blisters that had formed due to the crush of the trailer as it went over the leg and foot.  Ultimately several surgeries were performed providing a remarkable level of recovery.  The Plaintiff had an EBI external fixator placed to stabilize the leg.  Bone grafts were placed into the intermedial canal of the fracture.
 
Ultimately, Plaintiff recovered with some limitations.  Plaintiff retired about one year earlier that anticipated.
 
Plaintiff’s medical bills were paid for by worker’s compensation insurance which was ultimately fully waived upon settlement.  The insurance company and Plaintiff settled the claim for $500,000.00 with a waiver of a worker’s compensation claim in excess of $200,000.00.
